Weinstein & Cohen Achieves $3 Million in Damages for Botched Hernia Surgery

When Philip Serpico elected to have laparoscopic inguinal hernia surgery in 2005, he never suspected that the routine procedure performed by Dr. Ian Concilio would forever change his life. After the surgery, Serpico did not have the expected relief of pain. Instead his pain was far worse.

When the pain failed to diminish, Dr. Concilio performed an exploratory surgery that uncovered a tack, used as a fixation device, had damaged Serpico’s femoral nerve.  After undergoing numerous treatments, Serpico eventually underwent surgery to implant a spinal stimulator to try to reduce the nerve pain. The nerve injury made it difficult for him to bend or lift heavy objects and he never returned to his previous employment as an electrician.  Eventually Serpico had to find different job at a far lower income.

 

The $3 million verdict obtained by Weinstein & Cohen founding partner Judson Cohen on behalf of Philip Serpico was intended to help him receive fair and just compensation for the damages sustained in the botched hernia surgery.

 

“This was a unique case and through our disciplined approach and hard-nosed legal investigation, we were able to obtain a verdict commensurate with the pain and suffering that Philip has endured,” said Cohen. “It will never fix his nerve damage, but we’re pleased that the jury carefully considered the evidence and returned a verdict that reflected the substantial damage Philip endured as a result of the medical error.”

 

Dr. Concilio initially hired counsel who denied negligence. During the course of the case, Dr. Concilio’s attorney dropped out of the case and eventually Dr. Concilio failed to respond to court proceedings. As a result, a default judgment was entered against Dr. Concilio on liability. The matter proceeded to jury trial solely on the issue of damages.
