$1.6 Million Arbitration Award in Hospital Negligence Case

$1.6 Million Arbitration Award in Hospital Negligence Case

by | 0 comments

Weinstein & Cohen secured a $1,635,535 arbitration award on behalf of the Estate of Louis Watson and his surviving minor daughters following a tragic hospital error in Miami-Dade County.

Louis Watson, a devoted father of two young children, presented to Palmetto General Hospital with complaints of chest pain. Despite obvious signs of a cardiac condition, he was not properly treated for a heart-related emergency. Instead, he died while waiting for appropriate medical intervention.

Failure to Recognize and Treat a Cardiac Emergency

Emergency departments are trained to respond immediately to signs of cardiac distress. In this case, the evidence demonstrated that Mr. Watson’s symptoms warranted urgent cardiac evaluation and treatment.

A medical malpractice claim was initiated against the hospital and several physicians involved in his care. After the mandatory pre-suit screening process required under Florida’s Medical Malpractice Statutes, the hospital elected to proceed to arbitration.

Following the depositions of key witnesses, the matter proceeded before a three-member arbitration panel in Miami-Dade County.

Unanimous Arbitration Decision

After a week-long arbitration proceeding, the panel returned a unanimous award totaling $1,635,535 in favor of the Estate of Louis Watson and his surviving daughters.

The award reflects the devastating loss suffered by Mr. Watson’s family and the failure to timely diagnose and treat a life-threatening cardiac condition.

Judson L. Cohen and Mark S. Weinstein represented the Estate and Mr. Watson’s minor children throughout the proceedings.
